1. Eligibility and Prize

1.1. The OCBC Bank Personal Data Update for Family Segment Customers Lucky Draw (the “Promotion) is open to all Eligible Customers (defined below) from 24 May 2010 to 30 June 2010 (the “Promotion Period”) subject to these terms and conditions.

1.2. “Eligible Customers” refers to individuals;

(i) who have existing savings accounts under the OCBC Mighty Savers^TM Programme, OCBC Children Development Accounts or, OCBC SmartParent Accounts in good standing (as determined by OCBC Bank at its sole and absolute discretion) or who have purchased an insurance policy from OCBC Bank under the Family Segment category of products (as determined by OCBC Bank at its sole and absolute discretion), for the duration of the Promotion Period and

(ii) who have accurately updated, completed and duly signed the prescribed form (signature must match that in OCBC’s customer records).  The said prescribed form shall be in a form and substance prescribed by OCBC Bank. The said prescribed form must be received by OCBC Bank together with the relevant supporting documents no later than 30 June 2010.

1.3. All employees of OCBC Bank shall not be eligible for the Promotion.

2. Conduct of the Draw

2.1. Under the Promotion, each Eligible Customer is entitled to 1 lucky draw chance regardless of the number of accounts and/or products held at OCBC Bank (whether held in single or joint names). OCBC Bank reserves the right to disqualify any persons from the Promotion as OCBC Bank deems fit.

2.2. The draw for the Promotion (“Draw”) will be held at 3pm on 28 July 2010 at OCBC Bank, 63 Chulia Street, OCBC Centre East, Singapore 049514. 30 winners will be selected at random by OCBC Bank. The winners would be notified by ordinary post within 30 days of the Draw.

2.3. The prizes for the Draw are 10 top prizes of Nintendo Wii Sports set and 20 consolation prizes of Mighty Savers^TM Hampers. Each top prize includes the standard Nintendo Wii Sports set as packaged by the supplier.  The actual colour and specifications of the prizes may vary and differ from what is featured in any promotional materials.  The winner of the prize shall accept the prize "as is".  OCBC Bank makes no representation or warranty whatsoever as to the quality, merchantability or fitness for purpose or any other implied terms or conditions with respect to the prizes. The prizes must be claimed by the prize-winner in person at his/her risk and cost within 2 months of the date of notification. Unclaimed prizes may be forfeited without liability to the prize winner and distributed by OCBC Bank to such charitable organizations as it deems fit. All prizes are not transferable or exchangeable for cash, credit or in any kind.

3. General

3.1. Each participant in the Promotion hereby authorises OCBC Bank to contact him/her through his/her given contact details in any mode and manner that OCBC Bank may deem appropriate.

3.2. A customer shall not be entitled to win prizes with the Promotion if he/she is in default of any terms and conditions governing his/her account(s) or investment(s) with OCBC Bank or has ceased to hold the account or investment with OCBC Bank at the time the prizes are awarded. If any person is subsequently discovered to be not entitled or ineligible to participate in the Promotion or receive any prize or to otherwise be in breach of or not fulfil any of the terms and conditions herein, OCBC Bank may disqualify such person and forfeit or reclaim the prize at its discretion and take such other action as OCBC Bank shall deem fit in its sole and absolute discretion.

3.3. OCBC Bank reserves the right, at its sole and absolute discretion, at any time, without notice or assigning any reason therefore, to replace or substitute any prize in the Promotion with any other prize of equal or similar value selected by OCBC Bank.

3.4. OCBC Bank shall not be liable to any participant in the Promotion or any other persons for any loss or damage arising in connection with the Promotion, including without limitation, any error in computing any chances, any breakdown or malfunctions in any computer system or equipment. Without prejudice to the generality of the foregoing, OCBC Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage-due mail.

3.5. The decision of OCBC Bank on all matters relating to the Promotion including without limitation, the eligibility of any participant in the Promotion, the base and method of awarding the chances, any dates in connection with the Promotion and the timing of receipt of duly completed updates by OCBC Bank shall be final and binding on all participants of the Promotion and any other persons, including, without limitation, any decision to cancel or suspend the Promotion. No correspondence from any parties will be entertained by OCBC Bank.

3.6. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Promotion, these terms and conditions shall prevail.

3.7. OCBC Bank may at any time at its absolute discretion, without notice or assigning any reason therefore, delete, vary, supplement, amend or modify any one or more of these terms and conditions. In addition, OCBC Bank reserves the right at its absolute discretion without being required to assign any reason to terminate the Promotion without any liability on its part (whether accrued or otherwise).

3.8. Each participant in the Promotion shall indemnify OCBC Bank for any claims, actions, losses, damages or costs (including legal costs on a full indemnity basis) made against or incurred by OCBC Bank in respect of or in connection with the Promotion.

3.9. OCBC Bank’s record(s) and documentation on any matters in connection with the Promotion shall be binding and conclusive for all purposes and in any legal proceedings.

3.10. Without prejudice to these terms and conditions, all participants in the Promotion expressly and irrevocably permit and authorise OCBC Bank to disclose, reveal and divulge information regarding their particulars to the parties involved in organising, promoting and conducting any marketing or promotional activities in connection with the Promotion and any other party as OCBC Bank may consider necessary, expedient or desirable for the purpose of or in connection with the Promotion.

3.11. These terms and conditions shall be governed by the laws of Singapore and the participants in the Promotion irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.

3.12. A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions.
