Terms and Conditions Governing OCBC Premier LifeStyle Programme

1 DEFINITIONS

1.1 ‘Bank’ means Oversea-Chinese Banking Corporation Limited including its successors and assigns.

1.2 ‘Identifier’ means the OCBC Premier Lifestyle Card as issued by the Bank

1.3 ‘Credit Card’ means any MasterCard or VISA credit card issued by the Bank (whether or not it also bears the name and/or mark of any other person or entities) other than debit cards and corporate cards

1.4 ‘Card Account’ means the account of the Credit Card member maintained with the Bank in respect of the Card.

1.5 ‘Cardmember’ means a Principal Credit Card member of a Credit Card (whose Credit Card accounts have not been suspended or terminated).

1.6 ‘Merchant’ means an individual, firm or company engaged in the business of selling and/or providing goods and/or services, benefits or other privileges comprising the Premier Banking Lifestyle Programme.

1.7 ‘Programme’ means the OCBC Premier Lifestyle Programme as may be amended, supplemented and/or added by the Bank from time to time.

1.8 ‘Offer’ means any goods and/or services, benefits or other privileges, as may be determined by the Bank in its absolute discretion, which may be redeemed by producing the Identifier and making payment by an OCBC Credit Card under the Programme.

1.9 ‘Premier Lifestyle Catalogue’ means the catalogue sent to the premier banking customer or posted on the bank’s website

1.10 ‘S$’ means the lawful currency of Singapore.

1.11 Unless the context otherwise requires, words referring to the male gender shall include the female gender and neutral gender and words referring to the singular number shall include the plural number and vice versa. The headings to clauses are inserted for convenience of reference only.

2 PROGRAMME MECHANICS

2.1 The Programme is a by-invitation only Programme under which select few Premier Banking customers are issued an Identifier to give them access to certain merchant offers

2.2 Identifier: The OCBC Premier Lifestyle Card must be produced as an identifier at the point of sale to avail of the merchant offers as issued under the Programme.

2.3 Payment: Payment for any offers or benefits under the Programme can only be made using any Credit Card issued by the Bank.

2.4 Non-Transferable: Any offers extended under this Programme may not be exchanged for credit or transferred for the benefit of or used by any person other than the Premier Banking customer to whom the offer is awarded.

2.5 The offers under the Programme may be redeemed by such mode, within such period of time and in such manner as determined by the Bank and notified to the Cardmember or publicised by the Bank in any manner as it deems fit from time to time.

  3 ISSUE AND USE OF PROGRAMME OFFERS

3.1 Programme offers will be valid for three (3) months from the date of its issue or such other period as may be stated in the Premier Lifestyle Catalog and will cease to have any effect after its expiry. Use of the offers is subject to (i) the terms and conditions stated herein, on the Premier Lifestyle Catalog any other related communications and (ii) such other restrictions and/or conditions as may be imposed by the Merchant in relation to the Programme

3.2 Offers are not refundable or exchangeable for cash or OCBC$ or another reward.

3.3 The Bank is not an agent of the Merchant or vendor of any offers which are part of the Programme. The Bank shall not in any way be liable or responsible for the quantity, quality, merchantability, fitness purpose of any offers or the acts or default of the Merchant. Any dispute relating to the quantity, quality or performance of any offer or the failure of the Merchant to supply the benefit should be resolved directly with the Merchant.

4 OTHER CONDITIONS

4.1 The Bank shall be entitled to treat all instructions, whether oral, in writing or electronic, relating to the Programme or the use of the offers, which are purportedly given to the Bank by the Cardmember as the instructions of the Cardmember to act in accordance with such instructions.

4.2 The Bank's decision on all matters relating to or in connection with the Programme shall be final and binding on the holder of the Identifier.

4.3 The Bank shall have the absolute discretion to use agents, contractors or correspondents or other third parties to administer and/or implement the Programme and the Bank shall not be liable to any person for any act, omission or neglect on the part of such agents, contractors or correspondents. Any instruction to redeem an offer received by any agent, contractor, correspondent or other third party appointed by the Bank to obtain such instruction shall be binding on the Cardmember who has given or purportedly given such instruction and the Bank shall be entitled to act and rely on such instructions.

4.4 The Bank may at any time at its absolute discretion and upon written notice to the Cardmember, change any one or more of these Terms and Conditions. Such change(s) shall take effect from the date stated in the notice, which in most instances, shall be no less than 30 days from the date of the notice.

4.4A The Bank reserves the right and at any time at its absolute discretion and without giving any reason or notice to withdraw, cancel or invalidate any offers. No Cardmember shall be entitled to any payment or compensation whatsoever in respect of such withdrawal, cancellation or invalidation.

4.4B In the event of any inconsistency between these Terms and Conditions and any brochure, marketing or promotional material relating to the Programme, these Terms and Conditions shall prevail.

4.4C The Bank may notify the Cardmember of any changes to these Terms and Conditions by:-

i) publishing such changes in the Card Account statements to be sent to the Cardmember;

ii) displaying such changes at the Bank's branches or automated teller machines;

iii) posting such changes on the Bank's website;

iv) electronic mail or letter;

v) publishing such changes in any newspapers; or

vi) such other means of communication as the Bank may determine in its absolute discretion.

4.4D The Bank may, at its sole discretion and without prior notice, suspend the Programme at any time.

4.5 These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore and the Cardmember hereby submit to the non-exclusive jurisdiction of the courts of Singapore.

4.6 A person who is not a party to any agreement governed by these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act Cap 53B to enforce any of these Terms and Conditions.
